Powers of attorney are becoming much more important in the future for each of us, as we tend on average to grow older, which means that it is necessary to look at preparing for the event that might occur if capacity is lost.
Whilst loss of capacity is a medical decision Bannerman Burke Law are happy to help you with preparing a power of attorney, so that others can take over looking after your affairs in the event that incapacity strikes you.
It is always important to have this document in place because if you don’t have it then guardianship might be necessary. We can make it a relatively simple process and we will go through the complex provisions of a power of attorney document with you to make sure that it is tailored to your individual needs, and for you to select the appropriate attorney or attorneys. We will also deal with the registration process and take away the anxiety that any of that might cause.
If a power of attorney has not been obtained in the time of capacity, then we can help with the guardianship application which needs to be taken through the court. This can be if someone does not have the capacity to give a power of attorney or if that person didn’t get one in time before incapacity struck. Then in those circumstances, we would be in a position to help prepare and get the necessary reports from social workers and doctors to be able to progress the case through court and get the appropriate powers in place to protect that person’s needs, resources and interests whilst guiding you through the very complex procedure.
